Angry Taxing Online Cigarette Purchases

I received a very threatening letter yesterday from the State of Ohio demanding that I pay not only Sales Tax but Excise Tax for a carton of cigarettes I purchased online from CD2U on MARCH 30, 2009! I can see the sales tax, but Excise Tax, really? I think this company is out of business in CA and I'm thinking the only way Ohio could have found out about my purchase is by going through their records. I didn't realize we were being spied on to this degree.

Have you read the thread "What happened to Cigarettes Direct" in the General Smokers link. It directly relates to your problem and what the state of Ohio and some other states are doing. I beleive it has to do with the ATF confiscating all of that companys records and now going after previous customers to make them pay tax. Sounds almost criminal to me. Unbelievable what they'll do to collect taxes.

It IS criminal, what Ohio is doing in my opinion. Chances are really high that the cigarettes that davesmom bought way back in '09 probably did have tax stamps on them from whatever state those cigs came from. And instead of persecuting somebody over the taxes on 1 carton of smokes, why can't they just collect that money from the distribution state that collected taxes from the buyer??? How is the internet going to survive with all these idiots in the states' departments of revenue demanding additional tax monies on purchases where the taxes were already paid to the distribution states?

What if I buy a custom refrigerator from an online store in southern California and have it shipped to my home in NY? Is KING BLOOMBERG going to demand I pay NYS taxes on that in addition to the California sales tax I already paid? Because that is what is going on here with these states that are trying to collect taxes from purchases made years ago.

I bet if davesmom bought a tv online, Ohio could care less about collecting taxes on online purchases like that.

But since this carton was bought in 2009, how come it took Ohio 3 years to get his customer info from the ATF? I love it how states wait for 3-10 years (after cartons were bought) before they go after smokers who bought cartons online.

It doesn't take 3 years to find out customer info. I bet Ohio is in debt. And they're using this carton purchase as an excuse to steal this person's money in order to get rid of their debt.

If collecting the taxes is a threatening issue for real, Ohio should've sent him the threatening letter TWO years ago instead.

Hey all, I received the same letter from the state of Indiana Dept of Revenue 2 years ago for purchases from CD2U and other online tobacco sellers, for purchases made online from 2007 to 2010. the total tax bill was $3000.00 on unpaid Indiana tax on tobacco. After consulting my lawyer, and several more letters from the state, including the threat of garnishing wages and even forclosing on my house, I decided to pay the bastards. Set up a payment plan of $150.00 a month, which has been paid in full. Fair warning, if you purchased cigarettes from any site the injuns were operating, you will be found, and be subject to this harassment from your state. The Feds have all of the records, and the states are looking for any way to make up there tax shortages. Good Luck
